Pre-File Investigations

A pre-file investigation is another way of saying that you are being investigated for a possible crime. If you find that you are under suspicion of a crime but have not yet been formally charged you need to take action. It is best to retain a good criminal attorney. Your attorney will assist you with talking to police and answering questions. Your attorney will work with you and with the police to find out what is being investigated and why. It may seem as though if you simply avoid the situation it will go away. That simply isn’t the case. It is in your best interest to take immediate action by retaining an attorney.

Your attorney will advise you as to the best course of action to take. If you have not yet spoken to your attorney and are being questioned you should invoke your 5th amendment right to remain silent. Don’t think you can straighten out any misunderstandings by speaking to police. Instead, speak to your attorney first. Remember that anything you say may be used against you later. 

If you are being investigated for a crime, keep these things in mind:

  • Immediately hire a good criminal attorney
  • Don’t speak to police unless your attorney is present
  • Find out what the possible charges will be
  • Begin to find the information for your defense

The most important thing to remember is not to panic. Your attorney will often be able to get any possible charges reduced and can assist with asking for a lowered bail. If you are charged with a crime your attorney will work his hardest to defend you and keep you from being convicted.
